This Privacy Notice is revised 11th June 2022.

1. Introduction

Errand P Limited (“we”, “our” or “us”) is committed to ensuring that your privacy is protected. This Privacy Notice describes how we use the personal information that we collect from you, or that you provide, when you: visit our websites, download our app or use any of our products or services that we provide or communicate with us. We act as a Data Controller or a Data Processor within our relationship depending on the nature of services that we are providing to you.

This policy describes what you can expect from us and what we need from you in relation to your personal data. Please read this carefully as this policy is legally binding when you use our Services. If you have any questions about how we protect or use your data, please email us at privacy@errandpay.com .Check the Customer Agreement for the meaning of defined words (those with capital letters).

We keep our privacy policy under regular review and notification of any changes will be provided for your use.

It is important that personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your business relationship with us. In the event that we have not received information regarding a change of status on your personal data, please note that you inherently accept the responsibility for the information you provided and/or the failure to timely and accurately update your details.

2. Why do we collect information?

We collect Information for a number of important reasons, including:

  • To verify your identity
  • To process your orders and collect payment
  • To detect and prevent fraud
  • To detect and prevent use of the Services not in compliance with the User Agreement
  • To help the government combat money laundering and the financing of terrorist and other illegal activities
  • To resolve user disputes
  • To understand our users “preferences”
  • To improve the Services and the functioning of the websites
  • To communicate with you
  • To enable our third party service providers to fulfill their agreements with us for transaction processing and fraud detection
  • To enable promotional partners to fulfill their obligations

3. How do we protect your personal information

3.1. We are serious about guarding the security of your personal information and use a secure server to store your personal information. All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using Transport Layer Security technology.

3.2. As you will know, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data during transmission, and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

3.3. We restrict access of your personal information to our employees who have a business reason for knowing such information. We continuously educate and train our employees about the importance of confidentiality and privacy of customer information. We maintain physical, electronic and procedural safeguards that comply with the relevant laws and regulations to protect your personal information from unauthorized access.

4. How we may collect data:

4.1. Registration and use information – When you register to use our Services by establishing an Account, we will collect Personal Data as necessary to offer and fulfill the Services you request. Depending on the Services you choose, we may require you to provide us with your name, postal address, telephone number, email address and identification information to establish an Account. We may require you to provide us with additional Personal Data as you use our Services.

4.2. Transaction and experience information – When you use our Services or access our Sites, for example, to make purchases from merchants, to receive money, to process payments, or to send money or airtime to friends and family, we collect information about the transaction, as well as other information associated with the transaction such as amount sent or requested, amount paid for products or services, merchant information, including information about any funding instruments used to complete the transaction, Device Information, Technical Usage Data, and Geolocation Information.

4.3. Participant information – When you use our Services or access our Sites, we collect Personal Data you provide us about the other participants associated with the transaction.

4.4. Send or request money or airtime: When you send or request money or artime through the Services, we collect Personal Data such as name, postal address, telephone number, and financial account information about the participant who is receiving money from you or sending money to you. The extent of Personal Data required about a participant may vary depending on the Services you are using to send or request money or airtime.

4.5. Pay or request someone else to pay a bill: If you use our Services to pay a bill for the benefit of someone else, or if you request a User to pay a bill for you, we collect Personal Data from you about the account holder such as name, postal address, telephone number, email address, and account number of the bill that you intend to pay or request to be paid.

4.6. Add value to your accounts: If you use our Services to add value to your Account or any other account you may have, or if you ask a User to add value to any of these accounts, we may collect Personal Data from you about the other party, or from the other party about you to facilitate the request. For example, if you use our Services to reload a mobile phone, or to request value be added to your mobile account, we may collect Personal Data and other information including mobile account number from the other participant.

4.7. Information about your friends and contacts – It may be easier for us to help you transact with your friends and contacts if you provide Personal Data such as name, email address and telephone number about your friends and contacts while using a Service or if you connect your contact list or friend list to your Account. If you choose to connect your contact list information on your device with your Account and/or establish an account connection between a social media platform and your Account, we will collect and use your contact list or friend list information to improve your experience when you use the Services.

4.8. Information that you choose to provide us to obtain additional Services or specific online Services – If you request or participate in an optional Site feature, or request enhanced Services or other elective functionality, we may collect additional information from you. We will provide you with a separate notice at the time of collection, if the use of that information differs from the uses disclosed in this Privacy Policy.

4.9. Information about you if you transact as a guest – Certain limited Services are available without being required to log in to or establish an Account, also referred to as Guest Transactions. We will collect Personal Data, information about any funding instrument used to complete a Guest Transaction, Device Information, Technical Usage Data, and Geolocation Information as necessary to provide the requested Guest Transactions. If you are an Account holder and choose to make a Guest Transaction, we will collect information about the transaction and may associate it with your Account. If you are not an Account holder and choose to make a Guest Transaction, we will collect and store all information you provide and use and share such information in accordance with this Privacy Policy.

5. Category of data we may collect

5.1. Identity Data includes first name, last name, biometrics, username or similar identifier, title, date of birth and gender.

5.2. Contact Data includes billing address, delivery address, email address and telephone numbers.

5.3. Financial Data includes bank account and payment card details.

5.4. Usage Data includes information about how you use our Platforms, products and services.

5.5. Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

5.6. If required to help us verify your identity, you may provide us a copy of your government issued ID. If required to help us verify your residence, you may provide us with a utility bill, lease or other proof of residence. You may also provide us other verification documents, such as bank statements reflecting the source of funds, to meet international anti-money laundering regulations, or other legal requirements. By providing the verification information and documents mentioned above, you also provide us information within those records, which may include characteristics of protected classifications like your sex, age, national origin, and citizenship

6. Information you give us.

6.1. You may give us information about you when you sign up to use our service, e.g. when you provide us with your personal details, such as your name and email address. This also includes information you provide through your continued use of our Services, participate in discussion boards or other social media functions on our Website or App, enter a competition, promotion or survey, and when you report a problem with our Services. The information you give us may include your name, address, e-mail address, phone number, financial information (including credit card, debit card, or bank account information), payment reason, geographical location, social security number, personal description and photograph.

6.2. In providing the personal data of any individual (other than yourself) to us during your use of our Services, you promise that you have obtained consent from such individual to disclose his/her personal data to us, as well his/her consent to our collection, use and disclosure of such personal data, for the purposes set out in this Privacy Policy.

6.3. Information we obtain from third party sources:

We may receive personal information about you from third party sources but only where we believe that these third parties either have your consent or are otherwise legally permitted or required to disclose your personal information to us. We may receive information about you if you use any of the other websites we operate or the other services we provide. We are also working closely with third parties and may receive information about you from them.

For example:

the banks you use to transfer money to us will provide us with your basic personal information, such as your name and address, as well as your financial information such as your bank account details; business partners may provide us with your name and address, as well as financial information, such as card payment information.

6.4. Information we may automatically collect

  • details of the transactions you carry out when using our Services, including geographic location from which the transaction originates;

  • technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

  • information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our Website or App (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our Customer Support number.

6.5. Information from social media networks.

If you log in to our Services using your social media account (for example, Facebook or Google) we will receive relevant information that is necessary to enable our Services and authenticate you. The social media network will provide us with access to certain information that you have provided to them, including your name, profile image and e-mail address. We use such information, together with any other information you directly provide to us when registering or using our Services, to create your account and to communicate with you about the information, products and services that you request from us. You may also be able to specifically request that we have access to the contacts in your social media account so that you can send a referral link to your family and friends. We will use, disclose and store all of this information in accordance with this privacy policy.

7. Cookies

We and our partners use cookies and similar technologies on our website to help collect information and operate the site. We use cookies to remember Users and make your user experience easier; customize our services, content and advertising; help you ensure that your account security is not compromised, mitigate risk and prevent fraud; and to promote trust and safety on our website. Cookies are small text files placed by a website and stored by your browser on your device. Our cookies hold a unique random reference to you so that once you visit the site we can recognize who you are and provide certain content to you.

8. Use of the information

We use your information in the following ways:

  • to carry out our obligations relating to your contract with us and to provide you with the information, products and services;
  • to comply with any applicable legal and/or regulatory requirements;
  • to notify you about changes to our Services;
  • as part of our efforts to keep our Services safe and secure;
  • to administer our Services and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
  • to improve our Services and to ensure that they are presented in the most effective manner; to measure or understand the effectiveness of advertising we serve and to deliver relevant advertising to you;
  • to allow you to participate in interactive features of our Services, when you choose to do so;
  • to provide you with information about other similar goods and services we offer;
  • to provide you, or permit selected third parties to provide you, with information about goods or services we feel may interest you; or
  • to combine information, we receive from other sources with the information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).

9. Disclosure of your information

9.1. We may share your information with selected third parties including:

  • affiliates, business partners, suppliers and sub-contractors for the performance and execution of any contract we enter into with them or you;
  • advertisers and advertising networks solely to select and serve relevant adverts to you and others;
  • analytics and search engine providers that assist us in the improvement and optimisation of our site;
  • our group entities or subsidiaries
  • third party service providers and partners who provide data processing services to us (for example, to support the delivery of Services)
  • in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;

  • if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Customer Agreement and other applicable agreements; or to protect the rights, property, or safety of ErrandPay, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction;
  • to assist us in conducting or co-operating in investigations of fraud or other illegal activity where we believe it is reasonable and appropriate to do so;
  • to prevent and detect fraud or crime;
  • in response to a subpoena, warrant, court order, or as otherwise required by law;
  • to assess financial and insurance risks;
  • to recover debt or in relation to your insolvency; and
  • to develop customer relationships, services and systems.

10. Transfer of Data

10.1. As part of our service provision, we may rely on third-party servers, databases co-located with hosting providers, resident in foreign jurisdictions, which constitutes the transfer of your personal data to computers or servers in foreign countries. We take steps designed to ensure that the data we collect under this Privacy Policy is processed and protected according to the provisions of this Policy and applicable law wherever the data is located.

10.2. Where personal data is to be transferred to a country outside Nigeria, we shall put adequate measures in place to ensure the security of such personal data. Any transfer of personal data out of Nigeria will be in accordance with the provisions of relevant data protection regulations. In particular, we shall, among other things, use contractual terms to ensure protection of the data or ensure the country has adequate data protection laws (i.e. listed in Nigeria’s National Information Technology Development Agency’s [“NITDA”] White List of Countries, or the General Data Protection Regulation’s [“GDPR”] Adequacy List).

10.3. Should we intend to transfer personal data to a country deemed to have inadequate data protection laws, we will take all necessary steps to ensure that informed consent is obtained from you, and you are aware of the risks entailed with such transfer. In any instance, we will ensure personal data is transmitted in a safe and secure manner. Details of the protection given when your personal data is transferred abroad, and details of the basis of such transfers shall be provided to you upon request.

11. Profiling and Automated Decision Making

11.1. We may use your data to customize our Services and the information we provide to you, and to address your needs – such as your country of address and transaction history. For example, if you frequently send funds from one particular currency to another, we may use this information to inform you of new product updates or features that may be useful for you. When we do this, we take all necessary measures to ensure that your privacy and security are protected – and we only use pseudonymized data where ever possible. This activity has no legal effect on you.

11.2. As part of being a highly technical and innovative company, we may use Automated Decision Making (ADM) in order to improve your experience, or to help fight financial crime. For example, so that we can provide you with a fast and efficient service, we may use ADM to verify your identity documents, or to confirm the accuracy of the information you have provided to us. None of our ADM processes have a legal effect on you.

12. Data Retention

12.1. As a regulated financial institution, ErrandPay is required by law to store some of your personal and transactional data beyond the closure of your account with us. Your data is only accessed internally on a need to know basis, and it will only be accessed or processed if absolutely necessary.

12.2. We will always delete data that is no longer required by a relevant law or jurisdiction in which we operate.

12.3. We will retain your information as needed to provide you the Services for so long as you have an account with ErrandPay. If you cancel your account, we will retain your information as necessary in order to comply with applicable laws, rules and regulations.

13. Your rights

13.1. You have the right to ask us not to contact you for marketing purposes by contacting us at privacy@errandpay.com

13.2. You have the right to correct any personal information We hold on you that is inaccurate, incorrect, or out of date.

13.3. You have the right to ask us to delete your data when it is no longer necessary, or no longer subject to a legal obligation to which ErrandPay is subject to.

13.4. You have the right to transfer your personal data between data controllers, for example, to move your account details from one online platform to another.

13.5. Our Services may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility for them. Please check these policies before you submit any personal data to these websites.

14. Access to information

14.1. Subject to applicable laws, you may have the right to access information we held about you. Your right of access can be exercised in accordance with the relevant data protection legislation.

15.1. Any changes we may make to our privacy policy will be posted on this page and, where appropriate, notified to you by e-mail. Please check back frequently to see any updates or changes to our privacy policy.
